Abstract:

The procedural rules for the adjudicative proceedings before the Occupational Safety and Health Review Commission and its Administrative Law Judges are thoroughly revised. The revisions codify rules that have been developed by the Commission and appellate court decisions and modify existing rules or create new rules to remedy recurring procedural problems. These revised rules will take effect on December 6, 1986 and apply to all cases docketed on or after that date. They also apply to cases then pending, except to the extent that their application would be infeasible or would work injustice, in which event the present rules apply.
