Dear Mr. Dunn:
This is in response to your February 17 letter requesting a determination of compliance from the Occupational Safety and Health Administration (OSHA) for an inflatable fall arrest device.
The inflatable fall arrest device as described in your letter would be evaluated by OSHA using the net criteria. If this device meets the net criteria as set forth in 1926.502(c) and proves effective by preventing the test weight from contacting the ground, OSHA will consider the properly installed and maintained inflatable "Protection Safety Device" as meeting the intent of the standard and could be used for fall protection whenever nets are allowed by the standard. As noted in your letter, the net standards require the device to be installed no more than 30 feet below this walk/working surface on which employees are working.
If we can be of any further assistance please contact me or Mr. Dale Cavanaugh of my staff at (202) 219-8136.
Sincerely,

Your immediate attention is requested.
