Investigation Summary
At approximately 6:25 a.m. on August 11, 2017, Employee #1, (Driver) and Employee #2, (Helper) were collecting trash and recycling at residential stops on a two-lane paved surface state highway with a posted speed limit of 50 miles per hour. The crew was operating a Mack commercial motor vehicle (CMV) equipped with a split body refuse truck body to facilitate refuse collection. The crew was pulled over to the right-hand side of the highway blocking the driveway of a residential customer at the time of the incident. The CMV was equipped with hazard indicators and strobe light that were on at the time of the incident. Both employees were outside of the CMV and wearing ANSI Class 3 high visibility t-shirts conducting refuse collection activities. At the time of the incident Employee #1, a Caucasian male, approximately 47 years of age, was walking behind the CMV after emptying a recycle container and returning it to the customer's driveway while Employee #2 was emptying a trash container. A GMC van occupied by one operator approached the crew from behind. Employee #2 noticed the approaching van and reported that there was no indication that the operator saw the crew or the parked CMV. Employee #2 stepped back to the right shoulder of the highway as the van stuck Employee #1 and collided with the rear of the CMV. Employee #1 was pushed into the rear loading portion of the CMV and was killed as a result of the motor vehicle crash. Employee #2 was not injured and the van operator suffered a broken femur.
