Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that an employee was subjected to crushing type injuries while using a hoist which was suspended from an anchorage point that broke and fell on a worker due to a catastrophic weld failure. An employee operating a 1-1/2 ton come-a-long in the decking unit assembly of the assembly line was exposed to crushing type injuries in the event of a carriage falling accident due to the employers failure to uniformly and consistently review welding and cutting procedures on a daily basis. Recognition of the hazard of Safety in Welding and Cutting practices and the need for the use is evidence by certain requirements in the ASME/ANSI Z49.1:2005 consensus standard for SAFETY IN WELDING, CUTTING, AND ALLIED PROCESSES. The employer did not protect employees from the hazard of being crushed. An instance of this most recently occurred on December 30, 2015 when an employee constructing the assembly line decking unit was exposed and crushed by a falling/collapsing steel carriage. Abatement Certification is required for this item- Use the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET for this purpose. NOTE: IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM. FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 25 CFR 1903.19.
