Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to asphyxiation hazard: a) On or about June 17, 1986, and employee entered Bin #19 of the Johnson Cooperative Grain Co. elevator, located the Big Bow, Kansas, and was covered by moving grain. One feasible and acceptable abatement, among others, to correct this hazards is to establish and enforce a written bin entry procedure and permit system which would include at a minimum the following: 1) Prior to entry, ascertain unsafe conditions, such as, bridging or building of grain on the bin sides. 2) Insure that employees entering grain bins are using approved safety belt/harness and lifeline. 3) Insure that employees entering grain bins are adequately trained to perform their work task safely. 4) Insure that the employee observer monitoring employee(s) working inside grain bins, are trained in rescue procedures. 5) Insure management knowledge through use of bin entry permits.
