Text For Citation: 01 Item/Group: 001 Hazard:
OSH ACT of 1970 Section (5)(a)(1): The employer failed to furnish to each of his employees employment and a place of employment which was free from recognized hazards that were causing or are likely to cause death or serious physical harm, in that employees were exposed to fire and explosion hazards: (a) On or about January 4, 2017, for the employee who sustained fatal injuries while performing oil well startup operations at oil well site State of North Dakota 1-28x, Belfield, North Dakota. Abatement Note: Among other methods, one feasible and acceptable abatement method to correct the hazard would be for the employer to develop and enforce well start up procedures to include those for startup after extended shut down and training for persons assigned to operate or maintain the integrity of the equipment as stated in American Petroleum Institute (API) Recommended Practice 74, (Recommended Practice for Occupational Safety for Onshore Oil and Gas Production Operations) Section 9.1, Well Startup, and Section 8, Training.
