29 CFR 1910.178(l)(1)(ii): This standard is applicable to construction employment as defined by 29 CFR 1926.602(d): The employer did not ensure that each operator had successfully completed the training required by paragraph (l), except as permitted by paragraph (l)(5), prior to permitting an employee to operate a power industrial truck: The employer is failing to ensure employees have been evaluated and certified as outlined in paragraphs (l)(2), (l)(3) and (l)(6) of this subpart, to operate powered industrial trucks on this site. This was most recently documented at 204th St. & Maple St., Elkhorn, Nebraska on or about June 21st, 2017 when the employer had employees moving a rough terrain forklift on site without any form of training to do so.
