29 CFR 1910.252(a)(1): Fire protection and prevention responsibilities of welders and cutters, their supervisors (including outside contractors) and those in management on whose property cutting and welding was performed, as delineated in the Standard for Fire Prevention in Use of Cutting and Welding Processes, NFPA Standard 51B,1962, which is incorporated by reference as specified in Part 1910.6, were not observed: a) On or about November 17, 2017, four employees of Torchero Fenix LLC were cutting metal at the All Recycling, Inc. job site and one of the employees was cutting a loader axle. The heat from the oxygen/propane torch ignited the pressurized tire. The pressurized tire then failed catastrophically which caused the split rim to strike and lacerate the employee's upper body which resulted in the employee's death. All Recycling, Inc., as the controlling employer, did not ensure that employees of the subcontractor, Torchero Fenix LLC, were aware of the presence of the pressurized tire and associated hazards, in accordance with the Standard for Fire Prevention in Use of Cutting and Welding Processes, NFPA Standard 51B,1962, which states that management shall: "315. Advise all contractors about flammable materials or hazardous conditions of which they may not be aware."
