29 CFR 1910.28(b)(1)(i): The employer did not ensure that each employee on a walking-working surface with an unprotected side or edge that is 4 feet (1.2m) or more above a lower level was protected from falling by guardrail systems, safety net system, or personal fall arrest system: a) The employer did not ensure employee was protected from falling while cutting limbs. This violation occurred on or about January 3, 2018, at a workplace located at 5508 Frankford Ct., Dallas, TX; where employee, who was cutting limbs from the top of the tree, was exposed to the hazards of falling approximately 35-40 feet to the ground below.
