Section (5)(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or are likely to cause death or serious physical harm to employees in that employees placing traffic control devices, when there was a danger of traffic flow were exposed to struck-by hazards. a) On or about August 29, 2018, at the worksite located on highway US-24 east bound near mile marker number 65.5, Waterville, OH, employees were in the process of placing safety barrels on a posted 65 mph traveled roadway in order the delineate the interior shoulder. The employees gathered the barrels from a work vehicle parked on the eastbound non marked outside shoulder and intended on crossing live lanes of traffic to place the barrels. An employee positioned behind the work vehicle was fatally struck by a passenger vehicle. One feasible and acceptable method to correct this hazard is to develop and implement a site specific safety plan which identifies explicit procedures for traffic control and safe movement of workers across active highway lanes. This plan should consider and reference factors such as but not limited to: environmental concerns, equipment types and methods of communication. The employer should utilize ANSI A10.47 - 2009, in that prior to starting highway work, the employer should develop and implement a specific plan for safe worker access/egress to and from the work area.
