OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a struck-by hazard from a mixer cover. a) Mixer Area: The Teka # 3 pan mixer hood that weighed up 100 pounds was lifted and held open with a hook that was not equipped with a safety latch. The hook was designed with a latch to prevent slings or load from accidentally slipping off the hook, on or about 4/22/2019.
