OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to the hazard of a roll over and being crushed while operating a John Deere ProGator 2030A Utility Vehicle on a hilly terrain. a) On or about July 24, 2019, an employee of the Chicago Highlands Club, LLC was required to operate a ProGator 2030A Utility Vehicle, Product Identification Number TC203AT020455, with a 300 HD Sprayer attachment on a hilly section of the golf course. The utility vehicle was equipped with a Roll-Over Protection Structure (ROPS) and seat belts. However, the seat belt was not used. The employer did not ensure that effective steps were taken to eliminate the hazards associated with the operation of the utility vehicle on a hillside where there was a potential for the vehicle to rollover. The employee was exposed to fall, crush and struck-by hazards.
