OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: Location: In a trench located at the intersection of Farm Rd and Macy Rd in Briarcliff Manor, NY 10510 a) On or about November 20th, 2019, two employees were exposed to a struck-by hazards while working underneath the bucket of a Caterpillar Hydraulic Mini Excavator, (identifiers 308D CR EX164). NOTE: Because abatement of this violation is already documented in the inspection file, the employer need not submit certification or documentation of abatement for this violation as normally required by 29 CFR 1903.19
