OSH ACT of 1970 SECTION (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards: The employer is failing to protect workers from struck-by hazards in high traffic areas of the warehouse docking and southern trailer parking lots at night. This was most recently documented on or about February 17, 2020 at the facility located at 1915 East Kansas City Road, Olathe, Kansas. A shuttle driver had parked his tractor/trailer along the curb of the warehouse docking lot and was walking across the warehouse docking lot towards the building stairway, when a Kalmar truck struck and fatally injured the employee. The Kalmar truck was performing routine pickup and drop offs of trailers during the night time shift. The employer had not designated employee safe locations or walkways and crosswalks with painted lines on the docking lots. Among other methods, feasible and acceptable methods to correct or abate the hazards include, but are not limited to, ensure employees are protected by a written traffic control program which addresses at a minimum the following elements: 1. Designate employee safe locations, walkways and crosswalks with painted lines for all parking lots to protect all employees from being struck-by moving vehicles. 2. Ensure all employees including contractors are provided with high visibility vests in all vehicle traffic areas at the facility. 3. Prohibit all employees from walking into high traffic areas unless at a designated crosswalks. 4. Ensure that safety policy and rules are communicated to all employees including all temporary employees and contractors. 5. Ensure drivers obey speed limits and safe travel distances between vehicles at the facility. 6. Develop a monitoring plan to ensure all employees adhere to all safety rules in high traffic areas. 7. Ensure management conducts inspections throughout the facility lots and documents deficiencies or near miss incidents and takes appropriate corrective actions.
