29 CFR 1910.134(c)(1)(ix): The written respiratory protection program did not contain procedures for regularly evaluating the effectiveness of the program: a) Workplace, 3 North, 1 Clara Maass Drive, Belleville, NJ The effectiveness of the employer's written respiratory protection program was not regularly evaluated in that employees, including Certified Nursing Assistants (CNA's), were required to use surgical masks during the treatment and care of patients, including those under investigation for and/or confirmed as positive for COVID-19. During such operations, employees were not provided with a NIOSH-approved respirator such as an N-95 respirator to protect them from infection by the SARS-CoV-2 virus. Violation occurred on or about March 24, 2020 to March 30, 2020.
