29 CFR 1910.134(a)(2): A respirator was not provided by the employer to each employee when such equipment was necessary to protect the health of the employee: a) At the facility, 111 Central Avenue, Newark, NJ - Medical Surgical Unit A7: Employees working as Registered Nurses were required to use surgical masks while providing treatment and direct care to suspected COVID-19 positive patients. The employer did not provide NIOSH-approved respirators such as, but not limited to, N95 respirators to protect the employees from exposure to the SARS-CoV-2 virus. Violation occurred on or about 9/01/2020, and thereafter.
