29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. On or about April 29, 2020 and thereafter, at the Long Term Care 4th and 5th floors. The employer did not provide medical evaluations for employees such as housekeepers which conducted cleaning and disinfecting of surfaces, floors and restrooms inside the known or suspected COVID-19 positive patients rooms and were required to wear tight-fitting N95 respirators.
