Text For Citation: 01 Item/Group: 001 Hazard:
29 CFR OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing hazards while working under an unsecured elevator car: A) 133 East Clarke Place, Bronx - NY: Employees were directed to perform elevator modernization work in an elevator pit with an elevator car suspended above them that was not secured, "hung" or otherwise properly isolated. One employee was fatally crushed by the elevator car which fell from above. The employer did not take steps to control the physical hazardous energy presented by the unsecured elevator car, on or about February 18th, 2021. NOTE: The employer is required to submit abatement certification for this item in accordance with 29 CFR 1903.19.
