Text For Citation: 01 Item/Group: 001 Hazard:
Section 5(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to ejection and crushing hazards: (a) Kroskob Farms, LLC at 11491 CR 12, Fort Morgan, CO 80701: On or before July 6, 2021, the employer did not ensure employees were protected from ejection and crushing hazards. Employer did not require employees to properly fasten the seatbelt of Recreational Off-Highway Vehicles (ROHVs), including, but not limited to, a 2019 Polaris Ranger XP 900 EPS, while conducting daily job tasks such as checking water levels of pivot ponds. Employees would fasten the seatbelt and operate the vehicle with the seatbelt behind them. In the case of the 2019 Polaris Ranger XP 900 EPS, a seatbelt interlock would prevent speeds above 15 miles per hour when the seatbelt was not fastened. Operating the vehicle with the seatbelt fastened behind the driver allows the vehicle to reach speeds in excess of 60 miles per hour, without the safeguard of seatbelt restraint at such speeds. This condition exposed employees to serious bodily injury and even death caused from being partially or fully ejected from the vehicle when in operation. Abatement Note: Feasible and acceptable abatement methods include, but are not limited to: 1. Ensuring employees follow the procedures in the manufacturer's vehicle specific "Owner's Manual" with respect to proper and effective seatbelt use.
