OSH ACT of 1970 Section (5)(a)(1):The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that an employee was not protected from struck-by hazards while working in close proximity to excavator operations. (a) 260 East Main Street, Clarksburg WV: On March 24, 2022, employees were exposed to struck by hazards when working around a John Deer 210G excavator when the operator had an obstructed view.
