OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to fall hazards: On or about 9 July, 2022, at MCH Medical Center, 2&3 Estate Contant, St. Thomas, VI., employees engaged in painting operations were exposed to fall hazards. a) The JLG G5-18A Extended Reach Tele-Handler was positioned on a 15-degree slope while elevating employees. b) The JLG G5-18A Extended Reach Tele-Handler was left unattended while employees worked from an elevated work platform at a height of approximately 25ft that was not equipped with controls. Among other methods, feasible and acceptable methods to correct this hazardous condition would be: 1. Require the rough terrain truck to be positioned on level ground prior to elevating employees in accordance with Consensus Standard ANSI/ITSDF B56.6 Safety Standard for Rough Terrain Forklift Trucks Section 5.17.5. 2. Require the operator to remain within 25 feet of the truck and maintain visual contact with elevated employees in accordance with Consensus Standard ANSI/ITSDF B56.6 Safety Standard for Rough Terrain Forklift Trucks Section 5.17.5.
