Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recogn ized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to a potential crushing and/or fall hazard: (a) At the McLaughlin, SD, facility for employees being lifted in the b ucket of the Case W20C front end loader to gain access into the concrete storage bins and exposed to a potential crushing and/or fall hazard. Among other method s, one feasible and acceptable abatement method to correct this hazard is to pro hibit the use of a front end loader to lift personnel.
