Text For Citation: 01 Item/Group: 001 Hazard: CRUSHING
Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to engulfment hazards: On or about June 24, 2010, employees were exposed to grain engulfment and crushed-by hazards in that the employer allowed employees to work around a concrete structure that had a crack in it; there was a crack in the apex of bins 24, 25, and 34. The concrete was showing signs of separation thus diminishing the structural integrity of the structure. Among other methods, one feasible and acceptable method to correct this hazard is: Periodically inspect the elevator for structural defects and prohibit employees from working around the defective structure until it is either repaired or deemed safe by a qualified person. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
