Section 5(a)1 of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to falling load and crushing hazard: On or About January 20, 2012, at the jobsite, 1085 Pony Express Hwy., Marysville, Kansas, employees utilizing mechanical lifting magnets to move steel pipe were exposed to falling load / crushing hazards in that the magnets were not properly marked with their lifting capacity. AMONG OTHER METHODS, ONE FEASIBLE AND ACCEPTABLE METHOD TO CORRECT THIS HAZARD IS: 1. Conduct regular and periodic inspections of the magnets to ensure they are serviceable as referenced in ASME B30.20-1993, "Below the Hook Lifting Devices, Chapter 20-3.3.1 2. That magnets are properly labeled with the lifting capacity of the magnets and all other information as referenced in ASME B30.20-1993, "Below the Hook Lifing Devices, Chapter 20- 3.2.1 3. That magnets in use "Never lift more than 33% of the rated capacity", as instructed in the Magswitch Lifting Magnet Operation and Instruction Manual. 29 CFR 1903.19(d)(1) requires certification and documentation that the abatement of the above violation is completed.
