OSH ACT of 1970 Section (5)(a)(1): Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employee(s) in that employee(s) were exposed to the hazard of fire. On or about September 13, 2013, at the DA-203, the employer did not ensure that pyrophoric materials were removed prior to introduction of air into the DA-203 Caustic Wash Tower. Among other methods, feasible and acceptable abatement methods to correct the hazard includes, but is not limited to the following: a) A chemical rinse to remove the pyrophoric material prior to allowing dry pyrophoric material to come into contact with air.
