29 CFR 1910.134(a)(2): A respirator was not provided to each employee when such equipment was necessary to protect the health of such employee: a) The employer failed to supply adequate respiratory protection equipment to employees exposed to the SARS-CoV-2 virus known to cause COVID-19. On or about April 16, 2020, the employer did not provide N95 respirators to all staff who provided care to residents who displayed COVID-19 symptoms and/or were known to be COVID-19 positive. The employer allowed staff to choose between cloth face coverings, surgical masks, or N95 respirators when exposed to residents who displayed COVID-19 symptoms and/or were known to be COVID-19 positive.
