29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) On and after 3/28/2020, the employer did not provide a medical evaluation to determine Certified Nursing Assistants ability to use a respirator before they were required to wear respirators in the workplace. Certified Nursing Assistants provide patient care to residents with suspected or confirmed COVID-19. This patient care includes obtaining and recording vital signs and weight, assisting residents with ambulation and transfers, performing skin treatments, and feeding or assisting residents with meals. These employees were required to wear approved respirators when providing patient care to residents. b) On and after 3/28/2020, the employer did not provide a medical evaluation to determine Licensed Practical Nurses ability to use a respirator before they were required to wear respirators in the workplace. Licensed Practical Nurses provide patient care to residents with suspected or confirmed COVID-19. This patient care includes evaluating residents, administering various medications, and performing treatments. These employees were required to wear approved respirators when providing patient care to residents. c) On and after 3/28/2020, the employer did not provide a medical evaluation to determine Registered Nurses ability to use a respirator before they were required to wear respirators in the workplace. Registered Nurses provide patient care to residents with suspected or confirmed COVID-19. This patient care includes evaluating residents, administering various medications, and performing treatments. These employees were required to wear approved respirators when providing patient care to residents.
