29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace a) At the facility - 550 Jessup Road, Paulsboro NJ 08066. The employer provided and required the use of N95 respirators at that the facility. The employer did not provide a medical evaluation to employees, including but not limited to Registered Nurses (RNs) and Housekeeping staff, to determine the employees' ability to wear the respirators. The employees were providing direct care to and services to suspected and/or confirmed COVID-19 positive patients. The Violation occurred on or about 4/18/2020, and thereafter.
