29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) On or about 04/16/2020 and thereafter, Hunterdon Care Center required employees (Certified Nursing Assistants, Registered Nurses, and Activity Assistants) who provided direct patient care to suspected and confirmed COVID-19 patients to wear N95 respirators (e.g., Gerson 2130, Gerson 1739, 3M 9210/37021, 3M 8511, 3M 8210, and 3M1860). The employer did not ensure that medical evaluations were performed prior to the employees use of respirators. ABATEMENT DOCUMENTATION REQUIRED
