29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before requiring the employee to use a respirator in the workplace: a) 65 Highland Ave, Peapack NJ On or about March 30, 2020 and continuing thereafter, the employer did not provide a medical evaluation for employees, including Patient Care Assistants, who were required to wear N95 filtering facepiece respirators while engaged in the performance of their duties, which included assisting patients/residents with aspects of daily life, including bathing and brushing teeth.
