29 CFR 1910.134(d)(1)(ii): The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: a) On or about 03/17/20 at the Johnson Rehabilitation Institute; employees, (such as but not limited to Registered Nurses), provided treatment or care to COVID-19 positive or Patients Under Investigation (PUI) and were required to wear tight fitting filtering facepiece respirators,(such as but not limited to respirators labels as KN-95 masks made in China), which were not NIOSH certified, exposing them to the SARS-CoV-2 virus.
