29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator before the employee was fit tested or required to use the respirator in the workplace: a) Clearview Operating Co., LLC dba The Grand Rehabilitation and Nursing, Queens, 157-15 19th Avenue, Whitestone, New York: On or about April 8, 2020, and continuing thereafter, the employer did not provide medical evaluations for employees (including the Certified Nursing Assistants (CNAs) and the Rehab CNA) required to wear N95 respirators while providing treatment to COVID-19 positive residents and persons under investigation (PUI) for COVID-19.
