29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, East Neck Nursing and Rehabilitation Center, 134 Great East Neck Rd., West Babylon, NY. The employer provided and required environmental staff whose duties include housekeeping and maintenance, and dietary staff whose duties include serving meals to wear N95 respirators to protect them when exposed to patients suspected or confirmed positive for COVID-19. The employer did not provide these employees with a medical evaluation. Violation occurred on or about 5/14/2020, and thereafter. Note: In addition to abatement certification, the employer is required to provide abatement documentation for this item in accordance with 29 CFR 1903.19
