29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee�s ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Northern Wing, Subacute COVID Unit located at 1501 State Hwy 33, Hamilton Square, NJ 08690: On or about 5/6/2020, the employer failed to provide medical evaluations to employees who were required to wear N95 respirators. The employer required employees to wear N95 respirators (Inovel 3000, Medline 24506 and 24507, 3M 8210), when providing care to residents with suspected and confirmed cases of COVID-19.
