29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite - specific procedures was not established and implemented for required respirator use: a) 2509 South Fourth Operating, LLC, d/b/a St. Monica Center for Rehabilitation and Healthcare located at 2509 South Fourth Street, Philadelphia, PA 19148: On or about June 1, 2020, and thereafter, the employer did not develop and implement a written respiratory protection program with worksite-specific procedures for respirator use that included all provisions in 29 CFR 1910.134(c)(1)(i) - (ix). The employer required employees, including registered nurses, certified nursing assistants, and licensed practical nurses, to wear N95 respirators, including 3M brand N95 respirators model # 1860, while providing direct patient care to suspected and confirmed COVID-19 positive residents.
