29 CFR 1910.134(e)(1):The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: MedStar Washington Hospital Center located at 110 Irving Street, NW Washington, DC 20010: (a) On or about January 13, 2021, employees were required to wear N95 filtering facepiece respirators to protect against SARS-CoV-2 while performing housekeeping services in OR rooms that had been occupied by suspected or confirmed positive COVID-19 patients, and the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. (b) On or about January 25, 2021, employees were required to wear N95 filtering facepiece respirators to protect against SARS-CoV-2 while collecting registration or financial information from suspected or confirmed positive COVID-19 patients upon admission, and the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
