29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: (Construction Reference: 1926.103) At the jobsite located at 3939 S. Seneca St. Wichita, KS, employee(s) engaged in concrete construction activities, dry cutting on concrete, were exposed to pulmonary hazards and/or cardiac stress hazards in that the employer had not determined, through a medical evaluation, the employees' ability to use a respirator before the employee(s) are fit tested or required to use a respirator. Employees were required to utilize a 3M 8511 N95 particulate respirator.
