29 CFR 1910.176(a): Handling materials - general. Use of mechanical equipment. Where mechanical handling equipment is used, sufficient safe clearances shall be allowed for aisles, at loading docks, through doorways and wherever turns or passage must be made. Aisles and passageways shall be kept clear and in good repair, with no obstruction across or in aisles that could create a hazard. Permanent aisles and passageways shall be appropriately marked. a) On or about March 01, 2024, in the dock-trailer area, the employer did not ensure that there was sufficient safe clearance for the material handling from the dock area towards the back of the aisleway, in that forklifts were assigned to be parked in a non-marked area measuring approximately 20' from the back of the trailers where employees also move loads of steel tubing measuring approximately 21' and 24' in length, exposing employees to pinch point hazards from the steel tubing and the parked forklift.
