29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a. On or about August 13, 2019, and at times previously, in the chemical mixing and plant grow areas, the employer required employees to use tight fitting, half and full face, respirators, during the mixing and spray application of hazardous chemical type pesticides and fertilizers, without first having these employees complete a medical evaluation, exposing the employees to health hazards such as, but limited to acute and chronic respiratory injury and illness.
