29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: Location - 10 Green Way, Wayland, MA, 01778 On or about April 28, 2020, employees were required to wear N95 respirators within facilities for activities, such as, but not limited to, caring for residents and patients who tested positive for COVID-19 or were suspected of having COVID-19. Employer allowed employees to wear N95 respirators without medical evaluation.
