29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) On and after 3/28/2020, the employer did not ensure that Certified Nursing Assistants using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) was used, and at least annually thereafter. Certified Nursing Assistants provide patient care to residents with suspected or confirmed COVID-19 and were required to wear approved respirators when providing patient care to residents. b) On and after 3/28/2020, the employer did not ensure that Licensed Practical Nurses using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) was used, and at least annually thereafter. Licensed Practical Nurses provide patient care to residents with suspected or confirmed COVID-19 and were required to wear approved respirators when providing patient care to residents. c) On and after 3/28/2020, the employer did not ensure that Registered Nurses using a tight-fitting facepiece respirator were fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) was used, and at least annually thereafter. Registered Nurses provide patient care to residents with suspected or confirmed COVID-19 and were required to wear approved respirators when providing patient care to residents.
