29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a.) On and after April 3, 2020, at 144-61 38th Avenue, Flushing, NY 11354: Employees were provided with and required to wear N95 particulate respirators (3M Particulate Respirator 8210 N95) while performing job duties such as, but not limited to, providing care to confirmed and suspected COVID-19 positive nursing home residents. Employees were not provided a medical evaluation to determine their ability to wear a tight-fitting respirator.
