29 CFR 1910.134(e)(1): General. The employer shall provide a medical evaluation to determine the employee's ability to use a respirator, before the employee is fit tested or required to use the respirator in the workplace. The employer may discontinue an employee's medical evaluations when the employee is no longer required to use a respirator. Beginning on or about May 1, 2020 through June 9, 2020, nursing home staff were required to wear N95 (3M Model 8511HDX) respirators to protect them from exposure to the SARS-CoV-2 virus when performing tasks such as, but not limited to, feeding, bathing, maintaining continence, inserting and maintaining IV's, and conducting assessments for suspected or confirmed COVID-19 positive residents. The employer did not perform medical evaluations for affected employees in order to determine their ability to wear a respirator. Abatement documentation is required for this item in accordance with 29 CFR 1903.19(d).
