29 CFR 1910.134(f)(2): The employer did not ensure that an employee using a tight-fitting facepiece respirator is fit tested prior to initial use of the respirator, whenever a different respirator facepiece (size, style, model or make) is used, and at least annually thereafter: a) Care One at Livingston Assisted Living, 76 Passaic Avenue, Livingston, NJ 07039 The employer required employees including LPNs, CNAs, CHHAs and housekeepers to wear N-95 respirators to provide care for and/or clean rooms of Covid-19 patients under investigation or confirmed Covid-19 positive. However, the employer did not provide these employees with a fit test to ensure the N-95 fit the employee to protect them from exposure to the virus. Violation occurred on or about March 12, 2020 and thereafter.
