29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) COVID-19 Units on 2 West, PCU (Progressive Care Unit), and 4 East, Montclair Hospital, LLC. The employer required a physician to wear an N95 filtering facepiece respirator when providing treatment and care to patients including those under investigation and/or confirmed as COVID-19 positive. However, the employer did not provide this employee with a medical evaluation to ensure the employee was capable of safety wearing a respirator such as an N95. Violation occurred on or about 3/30/2020.
