29 CFR 1910.134(d)(1)(ii):The employer did not select and use a NIOSH-certified respirator in compliance with the conditions of its certification: Certus Healthcare dba Suburban Healthcare and Rehabilitation located at 20265 Emery Road, Cleveland, Ohio 44128: a. On or about July 29, 2020, the employer did not provide NIOSH-certified respirators to employees who were required to care for suspected and confirmed positive COVID-19 residents. The employer provided and required employees to wear respirators labeled "N95." However, the N95s did not contain certification markings indicating they were certified under NIOSH standards. The violation occurred on or about July 29, 2020 and after. b. On or about July 29, 2020, the employer did not provide NIOSH-certified respirators to Maxim Healthcare Staffing Services temporary employees who were required to care for suspected and confirmed positive COVID-19 residents. The employer provided and required these employees to wear respirators labeled "N95." However, the N95s did not contain certification markings indicating they were certified under NIOSH standards. The violation occurred on or about July 29, 2020 and after.
