29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) At the facility, 622 South Laurel Ave, Hazlet, NJ. The employer provided and required employees including Registered Nurses (RNs), Licensed Practical Nurse (LPNs), Certified Nursing Assistants (CNAs) and Housekeeping staff to wear N95 respirators. The employer did not provide a medical evaluation to determine if they were medically able to wear a respirators in the workplace. These employees provided direct care and services to patients with suspected and/or confirmed cases of COVID-19. Violation occurred on 5/19/2020, and thereafter.
