29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was required to use the respirator in the workplace: (a): Unit 2 North and South - The employer required employees, including but not limited to, Registered Nurses and Certified Nursing Assistants, to wear N95 respirators. The employer did not provide a medical evaluation to determine the employees' ability to use a respirator before the employees were required to use the respirator in the workplace. The employees were required to work with confirmed positive and suspected COVID-19 residents, on or about 04/09/2020 and after. Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).
