29 CFR l 910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) Highland Park Nursing & Rehab Center, LLC dba Aperion Care Highwood located at 50 Pleasant Avenue, Highwood, IL 60040. On or about November 29, 2020, and at times thereafter, the employer did not provide a medical evaluation to determine each employee's ability to use a respirator before requiring the use. The employer required employees to wear respirators while providing care to suspected and confirmed positive COVID-19 residents. In accordance with 29 CFR 1903.19(d), abatement certification is required for this violation (using the CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation demonstrating that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement, or other written records.
