29 CFR 1910.134(e)(1): The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace: a) On or about 5/2/2020 and thereafter, at 4915 10th Avenue Brooklyn, NY 11219, Licensed Practical Nurses and Certified Nursing Assistants working on the 6th floor caring for patients confirmed positive for COVID-19 were required to wear an N-95 respirator. The employer failed to provide employees a medical evaluation prior to respirator use. NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT CERTIFICATION OF ABATEMENT FOR THIS ITEM. FAILURE TO COMPLY MAY RESULT IN AN ADDITIONAL PENALTY.
